1. Introduction

These Terms of Service ("Terms") govern your use of the SourceLens platform, Chrome Extension, and related services (collectively, the "Service") provided by Highrank B.V., trading as SourceLens.

By creating an account, installing the Chrome Extension, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Definitions

• "Service" — The SourceLens web platform (sourcelens.ai), Chrome Extension, AI analysis features, and all related tools and functionalities.
• "User," "you," "your" — Any individual or entity that accesses or uses the Service.
• "Account" — Your registered SourceLens account.
• "Candidate Data" — LinkedIn profile data collected and analyzed through the Service, including names, job titles, employer history, and profile photographs.
• "AI Analysis" — The automated employer analysis, career pattern detection, matching scores, and InMail templates generated by our artificial intelligence systems.
• "Subscription" — Your paid or trial access plan to the Service.
• "Chrome Extension" — The SourceLens browser extension available through the Chrome Web Store.

3. Eligibility

To use the Service, you must:

• Be at least 18 years of age (or the age of legal majority in your jurisdiction)
• Have a valid LinkedIn account
• Have the legal authority to enter into these Terms (or be authorized by your organization to do so)
• Not be prohibited from using the Service under applicable law

4. Account Registration

4.1 Account Creation

You must provide accurate and complete information when creating your account. You are responsible for maintaining the accuracy of your account information.

4.2 Account Security

You are responsible for:

• Keeping your login credentials and API key confidential
• All activity that occurs under your account
• Notifying us immediately at info@sourcelens.ai if you suspect unauthorized access

We are not liable for losses resulting from unauthorized use of your account where you have failed to maintain adequate security.

4.3 One Account Per User

Each account is for a single user unless you are on a plan that explicitly supports multiple users (Professional tier). Sharing login credentials outside your authorized team is prohibited.

5. Subscriptions and Payment

5.1 Plans

The Service is available in the following tiers:

Pricing, features, and limits may change. Current pricing is always available at sourcelens.ai/pricing. We will notify existing subscribers at least 30 days before any price increases take effect on their account.

5.2 Free Trial

• The free trial lasts 14 days from account creation
• No credit card is required to start a trial
• There is no automatic conversion to a paid plan — you must actively subscribe
• Trial features may be limited compared to paid plans

5.3 Payment and Billing

• Subscriptions are billed monthly in advance
• Payments are processed securely through Stripe
• All prices are in Euros (€) and exclusive of applicable taxes (VAT)
• You authorize us to charge your payment method on file for recurring subscription fees

5.4 Cancellation

• You may cancel your subscription at any time through your account settings or by contacting info@sourcelens.ai
• Cancellation takes effect at the end of your current billing period
• No refunds are provided for partial billing periods
• Upon cancellation, you retain access to the Service until the end of your paid period
• After your subscription ends, your data is retained for 30 days before permanent deletion

5.5 Upgrades and Downgrades

• Upgrades take effect immediately; you are charged the pro-rated difference
• Downgrades take effect at the start of your next billing period
• Feature access adjusts according to your plan level

5.6 Promotional Pricing

Promotional pricing (such as launch offers) is subject to specific terms disclosed at the time of the offer. Users who subscribe during a promotional period may retain the promotional price as specified in the offer terms.

6. Acceptable Use

6.1 Permitted Use

You may use the Service for:

• Legitimate recruitment, talent acquisition, and sourcing activities
• Analyzing publicly available LinkedIn profile data for recruitment purposes
• Generating shortlists and match analyses for open positions
• Team-based recruitment workflows (Professional tier)

6.2 Prohibited Use

You may not use the Service to:

• Violate any applicable law, regulation, or third-party rights
• Scrape, harvest, or collect data beyond what the Service provides
• Reverse-engineer, decompile, or disassemble the Service
• Circumvent usage limits, security measures, or access controls
• Share your account, API key, or credentials with unauthorized parties
• Use the Service for any form of discrimination prohibited by law
• Resell, sublicense, or redistribute the Service or its output without authorization
• Send unsolicited bulk communications using data obtained through the Service
• Use the Service to build a competing product
• Interfere with or disrupt the Service infrastructure
• Use automated tools (bots, scripts) to interact with the Service beyond the provided Chrome Extension

6.3 LinkedIn Compliance

You acknowledge that:

• You are responsible for your own compliance with LinkedIn's terms of service
• The SourceLens Chrome Extension operates in SAFE MODE (URL extraction only) to minimize risk to your LinkedIn account
• SourceLens does not guarantee that use of the Service is fully compliant with LinkedIn's terms, as LinkedIn may change its terms at any time
• SourceLens is not affiliated with, endorsed by, or sponsored by LinkedIn Corporation

6.4 Data Protection Obligations

If you use the Service to process candidate data, you acknowledge that:

• You act as the data controller for candidate data you choose to analyze
• You are responsible for having a valid legal basis for processing candidate data (e.g., legitimate interest in recruitment)
• You must comply with applicable data protection laws (including GDPR) in your use of the Service
• You must respond to data subject requests from candidates whose data you process through the Service

7. Intellectual Property

7.1 Our Intellectual Property

The Service, including all software, algorithms, AI models, design, branding, and documentation, is owned by or licensed to Highrank B.V. All rights not expressly granted in these Terms are reserved.

7.2 Your Data

You retain ownership of all data you upload or input into the Service (including your matching criteria and project configurations). By using the Service, you grant us a limited license to process your data solely for the purpose of providing the Service.

7.3 AI-Generated Output

AI analysis results, match scores, employer analyses, and InMail templates generated by the Service are provided for your use in connection with the Service. You may use these outputs in your recruitment activities. However:

• AI-generated outputs should not be treated as verified facts (see Section 8)
• You may not claim AI-generated InMail templates as original human-written content in contexts where such representation would be misleading
• We do not guarantee the accuracy, completeness, or suitability of any AI-generated output

7.4 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us a non-exclusive, royalty-free, worldwide license to use this feedback to improve the Service.

8. AI Disclaimer and Limitations

8.1 AI-Generated Analysis

The Service uses artificial intelligence to analyze employer information and generate match scores. You acknowledge and agree that:

• AI analysis is not a substitute for human judgment. All AI-generated outputs (employer analyses, match scores, career pattern analysis, InMail templates) are automated assessments that may contain errors, inaccuracies, or omissions.
• Match scores are indicative, not definitive. A high match score does not guarantee candidate suitability, and a low score does not necessarily indicate unsuitability.
• Employer analysis may be incomplete or inaccurate. AI analysis is based on publicly available information and may not reflect the current state of an organization.
• You are responsible for verifying AI outputs. Before making hiring decisions, you should independently verify any information provided by the Service.
• AI models may change. We continuously improve our AI models, which may result in different outputs for the same input over time.

8.2 No Hiring Recommendations

SourceLens does not make hiring recommendations. The Service provides data analysis tools to assist recruiters in their decision-making. All hiring decisions remain your responsibility. SourceLens is not liable for any hiring decisions made based on or influenced by the Service.

8.3 AI and Bias

We strive to minimize bias in our AI systems. However, AI models may reflect biases present in their training data. You are responsible for ensuring that your use of the Service complies with anti-discrimination laws and regulations.

9. Service Availability and Support

9.1 Availability

We aim to provide the Service with reasonable uptime but do not guarantee uninterrupted or error-free operation. We may temporarily suspend the Service for maintenance, updates, or circumstances beyond our control.

9.2 Modifications

We may modify, update, or discontinue features of the Service at any time. For material changes that negatively affect your use of the Service, we will provide reasonable notice.

10. Limitation of Liability

10.1 Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available." We disclaim all warranties, express or implied, including but not limited to:

• Merchantability and fitness for a particular purpose
• Accuracy, completeness, or reliability of AI-generated outputs
• Uninterrupted or error-free operation
• Compatibility with your specific recruitment needs

10.2 Limitation of Liability

To the maximum extent permitted by applicable law:

• Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim
• We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, loss of data, loss of business opportunities, or reputational damage
• We are not liable for any damages arising from: hiring decisions influenced by the Service, inaccuracies in AI-generated analysis, actions taken by LinkedIn regarding your account, third-party service outages affecting the Service

10.3 Exceptions

Nothing in these Terms limits liability for:

• Fraud or fraudulent misrepresentation
• Death or personal injury caused by negligence
• Any liability that cannot be excluded under applicable Dutch or EU law

11. Indemnification

You agree to indemnify and hold harmless Highrank B.V., its officers, directors, and employees from any claims, damages, or expenses (including reasonable legal fees) arising from:

• Your violation of these Terms
• Your violation of applicable laws or third-party rights
• Your use of candidate data in violation of data protection laws
• Claims by candidates or third parties relating to your use of the Service

12. Termination

12.1 Termination by You

You may close your account at any time by contacting info@sourcelens.ai or through your account settings.

12.2 Termination by Us

We may suspend or terminate your account if:

• You breach these Terms
• You engage in prohibited use (Section 6.2)
• Your account has been inactive for more than 12 months (with prior notice)
• We are required to do so by law
• We discontinue the Service (with at least 30 days' notice)

12.3 Effect of Termination

Upon termination:

• Your access to the Service is revoked
• Your data is retained for 30 days, then permanently deleted
• Sections that by their nature should survive termination (including Sections 7, 8, 10, 11, and 13) will survive

13. Governing Law and Disputes

13.1 Governing Law

These Terms are governed by the laws of the Netherlands, without regard to conflict of law principles.

13.2 Dispute Resolution

We encourage you to contact us first at info@sourcelens.ai to resolve any disputes informally. If informal resolution is not possible:

• For business users: Disputes shall be submitted to the competent court in Amsterdam, the Netherlands
• For consumers in the EU: You may bring proceedings in the courts of your country of residence, and you may use the EU Online Dispute Resolution platform at ec.europa.eu/odr

14. General Provisions

14.1 Entire Agreement

These Terms, together with the Privacy Policy, Cookie Policy, and Disclaimer, constitute the entire agreement between you and Highrank B.V. regarding the Service.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full effect.

14.3 No Waiver

Failure to enforce any provision of these Terms does not constitute a waiver of that provision.

14.4 Assignment

You may not assign your rights under these Terms without our written consent. We may assign our rights to an affiliate or successor entity.

14.5 Force Majeure

We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to: natural disasters, war, pandemic, government action, internet or telecommunications failure, or third-party service outages.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes:

• We will notify registered users by email at least 30 days before the changes take effect
• We will update the "Last updated" date at the top of these Terms
• Continued use of the Service after the effective date constitutes acceptance of the updated Terms
• If you do not agree with the changes, you may cancel your subscription before the effective date
